1. Agreement
These Terms of Service ("Terms") govern your access to and use of the LocaleSense API and website (the "Service"), operated by [LEGAL ENTITY] ("we", "us"). By creating an account, generating an API key, or using the Service, you agree to these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind it.
2. The Service
LocaleSense is an informational data API. It returns commerce-related attributes for a country or IP address — currency and formatting rules, locale, tax rates, payment methods, exchange rates, and network and compliance signals. We do not process payments, hold funds, or execute transactions. The Service is a data input to your systems; the decisions you make with it are yours.
3. Accounts and API keys
You are responsible for safeguarding your API keys and for all activity under them. Keys are shown once at creation and stored only as a hash; we cannot recover a lost key. Notify us promptly of any unauthorised use. Accounts require passkey or password-plus-2FA authentication; you must keep your credentials secure.
4. Acceptable use
You agree not to:
- use the Service in violation of any applicable law, including export, sanctions, and data-protection law;
- exceed, evade, or interfere with rate limits, quotas, or usage metering;
- resell, redistribute, or sublicense the raw data as a competing dataset;
- attempt to breach the security of, reverse-engineer, or disrupt the Service;
- send full payment card numbers to any endpoint — the fraud endpoint accepts only the BIN (first 6–8 digits) and rejects longer input.
5. Data accuracy — no warranty
We work hard to keep the data correct and verify it against authoritative sources, but the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including accuracy, completeness, merchantability, or fitness for a particular purpose. Rates, tax rules, payment methods, and compliance status change frequently and may be out of date or incomplete. You are responsible for validating the data before relying on it for any decision that carries financial, legal, or regulatory consequence.
6. Sanctions and compliance
The compliance, sanctioned, and high_risk fields and
the fraud risk_score are informational signals, not legal or compliance
advice. They are a coarse, country-level overlay derived from public OFAC and FATF
sources and do not screen individual parties against the OFAC Specially Designated
Nationals (SDN) list or any other sanctions list. You remain solely responsible for
your own sanctions, anti-money-laundering, and export-control compliance, including
party-level screening. Do not use the Service as your sole or primary compliance control.
7. Billing
Paid tiers are billed in advance through our payment processor (Stripe). Quotas reset monthly; usage is metered per request. Fees are non-refundable except where required by law. We may change pricing on notice; changes apply to the next billing cycle. Failure to pay may result in suspension or downgrade.
8. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill — including any loss arising from a decision you made in reliance on the data, or from any compliance, sanctions, or fraud outcome. Our total aggregate liability for any claim arising out of the Service will not exceed the fees you paid to us in the three months preceding the claim.
9. Indemnification
You agree to indemnify and hold us harmless from any claim arising out of your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
10. Suspension and termination
We may suspend or terminate access for breach of these Terms, non-payment, or to comply with law. You may stop using the Service at any time. Provisions that by their nature should survive termination (including sections 5, 6, 8, and 9) will survive.
11. Changes
We may update these Terms; material changes will be notified through the Service or by email. Continued use after a change constitutes acceptance.
12. Governing law
These Terms are governed by the laws of [JURISDICTION], without regard to conflict-of-laws principles. The courts of [JURISDICTION] have exclusive jurisdiction over any dispute.
